California Supreme Court Will Not Expedite Marriage Case
The legal and political battle over “same-sex marriage” is becoming increasingly convoluted as cases move back and forth between Federal and State courts, elected officials decide not to defend but still enforce existing laws, and national and state laws impact each other amid the entangled legal fights.
The California Supreme Court is being asked by a Federal court for clarification on the authority of Proposition 8 supporters to defend the measure when elected officials do not. The Federal court is concerned that if someone is not allowed to defend a proposition, elected officials can ignore a legitimate vote of the people. The California Court said this week that it will not rush that decision and set arguments for September, after its summer recess.
